French Judge Contemplates Cheney Indictment

According to an article in Le Figaro, (translated article here courtesy of Ocnus.net), French courts for the first time have opened an investigation with regard to the bribery of a foreign public official. The case involves a contract by a consortium which includes the American company Kellogg, Brown and Root (KBR), a Halliburton subsidiary, and a French company, Technip, to supply a gas complex to Nigeria. Paris investigating magistrate Judge Renaud Van Ruymbeke has been conducting investigations since October into allegations that $180m were paid in secret commissions during the late 1990s up to 2002 from funds established by the consortium in Madeira, and is considering an eventual indictment Vice President Cheney, in his capacity as former CEO of Halliburton. Cheney was Halliburton's chief executive between 1995 and 2000.

In a letter to the attorney-general's department, magistrate Reynaud van Ruymbeke ruled out directly prosecuting Cheney on a charge of bribing foreign officials, Le Figaro said, but the official did not exclude the possibility of prosecution on the grounds of complicity in misuse of corporate assets.

Update - and Correction

There are more details on the FCC imposed conditions on NewsCorp's purchase of DirectTV (motto: "Feel the Joy") as mentioned in our December 19th post. According to Reuters, one condition forces DirecTV to give local broadcasters in 130 markets access to its satellite system in the U.S. by 2004. Another includes a process through which NewsCorp must face a neutral third party arbitrator in program disputes with cable operators. Analysts feel that this provision is likely to limit Fox Entertainment Group's ability to extract higher fees. The FCC also barred the company from withholding Fox local broadcast channels, including its regional sports networks, during disputes, a tactic used effectively in programmer and cable operator disputes in the past.

Rising Cable Television Rates and Shrinking Satellite Choice

Activist Jim Hightower has issued a call for everyone to protest additional cable rate increases by contacting Consumers Union at 202/462-6262. As you recall, the cable industry through their lobbyists convinced Congress to deregulate the industry by arguing that deregulation would ultimately lead to lower cable rates. So why have rates been on the increase? Jim explains in his column (accessible here through the Austin Chronicle).

Before you rush out and switch to satellite television, be aware that Media Overlord Rupert Murdoch was given the go-ahead to purchase Direct TV. According to Reuters, the approval went through the FCC in a 3-2 vote on condition that NewsCorp (Murdoch's media corporation) does not use the leverage to pressure cable and satellite rivals who wish to carry NewsCorp content. According to FCC Chairman Michael Powell, "Cable and satellite customers will continue to have access to programming from a diverse source of media outlets. "With these conditions, I believe the transaction serves the public interest." The deal was also approved by the Justice Department's antitrust division. The two dissenting voices on the FCC panel cited fears of rising rates for consumers, and concerns about limits on DirecTV's plan to offer local channels in more markets. More importantly, nothing really stops NewsCorp from limiting competitive channel access on satellite.
